Terms of Service

1. Services and Pricing

Clients may choose individual services or a bundled package. All pricing is in AUD and inclusive of GST.

Service pricing:
• Ad campaign management – $1,200 per month
• Organic account management – $400 per month
• Ad content videography:
 – $1,500 per month (monthly)
 – $750 per month (bi-monthly)
 – $500 per month (quarterly)
 – $250 per month (half-yearly)
• Organic content videography:
 – $1,000 per month (monthly)
 – $500 per month (bi-monthly)
 – $350 per month (quarterly)
 – $175 per month (half-yearly)
• Lead management software – $200 per month
• Personal receptionist – $500 per month

2. Default Packages

'Momentum Builder'

• $1,500 setup fee + $1,700 per month
• Includes:
 – Ad campaign management
 – Free ad content shoot every 3 months

'Growth Accelerator'

• $1,500 setup fee + $2,450 per month
• Includes:
 – Ad campaign management
 – Social media account management
 – Free ad content shoot every 3 months
 – Free organic content shoot every 3 months

'Market Leader'

• $1,500 setup fee + $4,800 per month
• Includes:
 – Ad campaign management
 – Social media account management
 – Free ad content shoot every month
 – Free organic content shoot every month
 – Lead management software
 – Personal receptionist

3. Service Definitions

Ad campaign management: We run your Meta ad campaigns, including account setup, creative testing, ongoing optimisation, and monthly reporting.
Organic social media management: We schedule posts, stories, and content provided by you. Posting frequency is at our discretion and depends on content volume.
Ad content video shoot: On-site shoot producing up to 2 (1 min long) videos (2-hour session, 1 location). Used primarily for ad creatives.
Organic content video shoot: On-site shoot producing up to 4 short-form (30s) reels. Used primarily for organic posting.
Lead management software: Includes CRM pipeline, automations, email marketing, review collection, dashboards, and login access.
Personal receptionist: Our virtual receptionist responds to leads generated through our system, handles inbound messages, follows up leads, and books appointments.
Ad spend: Paid directly to Meta or other platforms by you. It is not included in your payment to BC Digital and is your responsibility.

4. Guarantee – 30-Day Satisfaction Guarantee

If you’re not completely satisfied within 30 days of your campaign launch, you may request a refund of the monthly service fee by emailing ethan@bcdigital.com.au with your reason for dissatisfaction.
• Does not include setup fee or ad spend.
• Refunds processed within 10 business days.
• If no refund claim is made within 30 days of launch, this guarantee is voided.

5. Client Responsibilities

• Attend sales consultations with leads and provide quotes.
• Join a monthly review call to provide feedback.
• Ensure Meta ad spend is funded and paid directly.
• Provide all required business assets, content, and approvals in a timely manner.

6. Payment Terms and Cancellation

• Minimum 3-month commitment on all services.
• Early cancellations require payment of the full 3-month term.
• After 3 months, cancellations require 30 days’ written notice via the cancellation form.
• Any payments due during this 30-day notice period must be paid.
• An exit interview (via video call) is required before cancellation is finalised.

7. Pausing Services

• Services may be paused with 14 days' written notice via the pause request form.
• Any invoices due before the pause must still be paid.
• A resume date must be provided.
• Maximum pause duration is 3 months — longer pauses require a new request.

8. Liability Disclaimer

• BC Digital is not liable for any financial loss, missed opportunity, or business damages.
• You assume full responsibility for your lead handling, quoting, and closing results.
• While we aim to generate qualified leads, results are not guaranteed due to variables beyond our control.

9. Confidentiality

• You agree to keep all business information of BC Digital and its operating procedures confidential unless required by law or explicitly approved in writing.

10. Intellectual Property

• All work, leads, creative assets, and materials produced remain the property of BC Digital unless otherwise agreed in writing.
• You may not reuse or redistribute any materials created by us without written permission.

11. Force Majeure

• BC Digital is not liable for any delay or service failure due to events beyond our control (e.g. illness, natural disasters, platform outages, etc.).

12. Video Shoots

• Video shoots are a maximum of 2 hours.
• Travel time between multiple locations counts toward session time.
• Locations must be clean, accessible, and prepped.
• Delays caused by the client will reduce available shoot time at your expense.
• Additional filming beyond the scheduled session will incur extra charges.
• Locations outside a 1-hour travel radius will incur a $100/hour travel fee.
• The videographer may end the shoot early if all required footage is captured.

13. Client Responsibilities for Video Shoots

• Appear on camera or send a delegate at your own expense.
• Prepare and grant access to all locations.
• Cover the cost of any external venue, actor, or extra equipment needed.
• You are responsible for scheduling video shoots.
• Unused video sessions expire if not used within 1 month of their scheduled quarter.

14. Cancellations and Rescheduling

• A $500 minimum cancellation fee applies once a shoot is booked.
• Outdoor filming may need to be rescheduled due to weather — rescheduling fees may apply.

15. Revisions and Delivery

• Includes 1 round of video revisions. If you do not use this revision within 7 days, it is voided.
• Additional revisions are charged at $150/hour.
• Standard delivery time is 10 business days post-shoot.
• All videos are delivered digitally via download link or file transfer.

16. Ownership and Usage Rights

• BC Digital retains ownership of all video and campaign assets unless otherwise agreed.
• Redistribution or modification of our work outside the original agreement requires written permission.

17. Dispute Resolution and Governing Law

• These terms are governed by the laws of New South Wales, Australia.
• In the event of a dispute, both parties agree to attempt mediation before pursuing legal action.
